The Courts and the Colonies: The Litigation of Hutterite Church Disputes

Esau (law, U. of Manitoba) focuses on Hutterite litigation generally, but particularly on the Manitoba case of Lakeside Colony v. Hofer, in which leaders of the colony and conference launched a lawsuit against another group of Hutterites who had allegedly been excommunicated but would not leave the colony. One central pillar of the Hutterite religion is the refusal to use violence against others, he says, and initiating a civil lawsuit ultimately involves an aggressive act of getting court orders backed by the sword of the state.
